Why we formed General Counsel Mediation.

     “Because you should be in control”, General Counsel Mediation, LLC provides a unique forum for disputing parties to resolve their disputes in a confidential, non-judgmental manner.

     If asked directly, few people would choose to put their most critical decisions in the hands of strangers. Yet, essentially that is what happens day after day, when a jury of 12 strangers or even a judge hands down decisions in litigation.

     We formed General Counsel Mediation, LLC to help put the parties back in control of litigation. Mediation is a facilitated negotiation between the parties. It provides an opportunity to avoid litigation altogether, or to resolve litigation at an early stage, thus avoiding the negatives of the litigation process.

     We are each former Vice Presidents & General Counsels of NYSE companies who have substantial experience in dealing with and resolving disputes involving business, commercial, construction, and community issues.

     In our role as General Counsel, we served as both lawyer and client. We have extensive hands-on experience in managing litigation, conducting win-win negotiations in a broad commercial context, and resolving disputes through alternative dispute resolution. We understand the frustration of litigation - the mounting expenses, consumption of time and other resources, the loss of focus on other matters, and the emotional drain.

     We know how business people approach issues. We believe that our experience provides unique insights that can help parties resolve disputes involving business considerations.

     The philosophy of General Counsel Mediation is that mediation works best when it is conducted by a mediator who is an active facilitator with an understanding of the substantive issues involved, and with the ability to help the parties think “outside the box.”
